WHAT IS ADVERSE POSSESSION?

Adverse Possession involves a situation where someone tries to claim land that belongs to you (or you try to claim possession of someone else’s land) simply because they have used or “possessed” the land for a statutorily set time. In the “old days,” it usually involved large estates or farm lands where property boundaries were not clearly demarcated.

In modern times, Adverse Possession claims in Nassau County are on the rise. With more and more homeowners erecting fences, property line disputes are increasing each year.

Suppose you believe your property line extends to your neighbor’s fence line.
